Yellow Fly Information and Kit Request

A trapping method homeowners can use, which does not involve the use of pesticides, is called the “Yellow Fly Sticky Trap”. Basically it is a beach ball, (milk jugs work just as well and are easier to hang) painted black and coated with a sticky substance. The sticky substance is called Tangle-Trap and comes in a spray or liquid applicator. It can be found at local Hardware stores.

These devices are hung from a tree limb using string, in a shaded area, about 4 feet above the ground. Movement of the ball by the wind attracts the flies, thinking it is an animal, they land, get stuck, and die on the ball. Several of these balls will reduce the local adult populations.

You can also create your own “ball” using a milk jug, spray paint it a dark color and apply a sticky substance.

DISTRIBUTION OF YELLOW FLY KITS FOR RESIDENTS

  By completing this online form, Agreement has been made electronically, knowingly and voluntarily, by the Parties listed in this request.

THIS INDEMNIFICATION AND HOLD HARMLESS AGREEMENT (the “Agreement”) made and entered into between “Resident”, and the South Walton County Mosquito Control District, and independent special district of the State of Florida (“SWCMCD”), collectively referred to as the “Parties.” WHEREAS, Resident wishes to obtain a yellow fly kit (“kit”) from the South Walton County Mosquito Control District, an independent special district of the State of Florida (“SWCMCD”), to be used to control yellow flies in and around his/her property; and

WHEREAS, Resident represents that no one in his/her household, including any minor children, have health problems that would endanger any such person in the use of the kit provided by the SWCMCD.

NOW, THEREFORE, in consideration of the covenants hereinafter expressed and other good and valuable consideration, Resident agrees as follows:

The foregoing Whereas clauses are true and correct and are incorporated by reference herein into this Agreement.

Resident agrees to follow all instructions included with the kit. Resident understands and agrees that the kit contains materials that may be hazardous to humans and pets, and is aware of the inherent problems or dangers that may arise from the use of these materials.

Resident agrees to indemnify and hold harmless SWCMCD, its agents, officers, Board of Commissioners, employees, from any and all claims, proceedings, causes of actions or damages, including attorney’s fees and costs, which may hereafter arise from his/her possession, use, or disposal of the kit.

The undersigned acknowledges that specific consideration has been given for this hold harmless and indemnity provision.

Resident represents that the individual who has signed this Agreement has the actual legal power, right, and authority to make this Agreement and bind him/herself to this Agreement.

Resident hereby declares and certifies that he/she is over the age of 18 years.

This Agreement will be binding upon and inure to the benefit of Resident, the SWCMCD, and their successors and assigns.

No provision, term, or condition of this Agreement will be construed as a waiver of any rights provided for by any provision of law, including but not limited to Section 768.28, F.S.

No waiver of any default shall constitute a waiver of any other default or breach, whether of the same or other covenant or condition. No waiver, benefit, privilege, or service voluntarily given or performed by a party shall give the other party any contractual right by custom, estoppel, or otherwise.

This Agreement may be enforced in any manner authorized by law, and does not preclude SWCMCD from seeking judicial or administrative remedies for violation of the terms or conditions of this Agreement.

This Agreement shall be governed by and construed under the laws of the State of Florida. Venue lies in Walton County, Florida. If any term, covenant, or condition of this Agreement or the application thereof to any person or circumstances will, to any extent, be deemed lawfully invalid or unenforceable, the remainder of this Agreement or the application of such term, covenant, or condition to persons or circumstances other than those as to which it is held to be invalid or unenforceable, will not be affected thereby and each term, covenant, and condition of this Agreement will be valid and enforced to the fullest extent permitted by law.

Resident shall bear its own costs and attorney’s fees related to this matter.

This Agreement shall become effective as of the date signed by Resident, as designated below.
